INTELLECTUAL PROPERTY

All content published and made available on our Site is the property of ALFARALE and the Site’s creators. This includes, but is not limited to images, text, logos, documents, downloadable files, trademarks, copyrighted material and anything that contributes to the composition of our Site.

ACCEPTABLE USE

As a user of our Site, you agree to use our Site legally, not to use our Site for illegal purposes, and not to:

• Violate the intellectual property rights of the Site owners or any third party to the Site;
• Hack into the account of another user of the Site;
• Act in any way that could be considered fraudulent;
• Use third party accounts to redeem benefits of any promotions;
• Use any data extraction methods;
• Modify, copy or duplicate any content or promotion posted or produced or sent by email by the website;
• Intrude with our service privacy and protection to any or all users, hosts and/or networks by any form of harassing, spamming, phishing DOS/DDOS, mail hacking, or any other form of virus/trojans.

If we believe you are using our Site illegally or in a manner that violates these Terms and Conditions, we reserve the right to limit, suspend or terminate your access to our Site. We also reserve the right to take any legal steps necessary to prevent you from accessing our Site.

Personal data that you provide us with will be processed in accordance with the General Data Protection Regulation (GDPR) 2016 and the Law providing for the Protection of Natural Persons with regard to the Processing of Personal Data and for the Free Movement of such Data of 2018 (Law 125(I)/2018).

SALE OF SERVICE

These Terms and Conditions govern the sale of services available on our Site.

We are under a legal duty to supply goods that match the description of the good(s) you order on our Site.

The following services are available on our Site:

• Sale of original artworks;
• Sale of original art paintings;
• Sale of high-quality art prints;
• Sale of art books.

The services will be paid for in full when the services are ordered.

These Terms and Conditions apply to all the services that are displayed on our Site at the time you access it. All information, descriptions, or images that we provide about our services are as accurate as possible. However, we are not legally bound by such information, descriptions, or images as we cannot guarantee the accuracy of all services we provide. You agree to use promotional services from our Site at your own risk.

We reserve the right to modify, reject or cancel your order whenever it becomes necessary. If we cancel your order and have already processed your payment, we will give you a refund equal to the amount you paid upon your request by contacting the email info@alfarale.com. . You agree that it is your responsibility to monitor your payment instrument to verify receipt of any refund.

CANCELLATION PRIVACY

The client has the right to cancel an order within 24 hours from the time of the placement of the order. If the cancellation is made after the lapse of 24 hours from the time of the placement of the order, no refunds will be applicable.

When you provide us with your payment information, you authorise our use of and access to the payment instrument you have chosen to use. By providing us with your payment information, you authorise us to charge the amount due to this payment instrument.

If we believe your payment has violated any law or these Terms and Conditions, we reserve the right to cancel or reverse your transaction.

SHIPPING PRIVACY

Worldwide free shipping of artworks/ art paintings/ art prints and art books.

All orders will be processed within a period from 48 hours to 14 days from the time of the placement of the order, depending on the country that the artworks will be shipped. Orders are not dispatched on weekends or on holidays.

If we are experiencing a high volume of orders, shipments may be delayed by a few days. Please allow additional days in transit for delivery. If there will be a significant delay in shipment of your order, we will contact you via email or telephone.

SHIPPING METHOD AND PACKAGING

We ship worldwide with UPS Shipping Company (“UPS”). UPS may use the email address and/or mobile number provided to update the receiver about the status of their package.

All original artworks and art paintings, whether framed or not, will be packaged safely and, as the case might be, in specific wooden boxes. Art prints and art books, as well as any other work on paper will also be packaged safely. The packaging of all orders will made 48 hours from the time of placement of the order.

SHIPMENT CONFIRMATION & ORDER TRACKING

You will receive a shipment confirmation email once your order has been shipped containing the relevant UPS tracking number(s). The tracking number(s) will be active within 24 hours and as per the applicable UPS policy.

REFUNDS

Refunds are only applicable in case of cancellation of the order within 24h.

CONSUMER PROTECTION LAW

This Site is controlled and operated in the Republic of Cyprus. Where the Consumer Protection Law of 2021 (Law 112(I)/2021) and/or Sale of Goods Law, Law 10(I)/1994 and/or The Law on certain legal aspects of information society services, in particular electronic commerce and relevant matters of 2004 (Law 156(I)/2004) and/or any other consumer protection legislation in Cyprus applies and cannot be excluded, these Terms and Conditions will not limit your legal rights and remedies under that legislation. These Terms and Conditions will be read subject to the mandatory provisions of that legislation. If there is a conflict between these Terms and Conditions and that legislation, the mandatory provisions of the legislation will apply.

LIMITATION OF LIABILITY

ALFARALE and the owner, any directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of the Site.

INDEMNITY

Except where prohibited by law, by using this Site you indemnify and hold harmless ALFARALE and its owner, any directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our Site or your violation of these Terms and Conditions.

JURISDICTION AND LAW

These Terms and Conditions are governed by the laws of Cyprus.

Any disputes arising out of any act or contract to which these provisions apply, save as provided by (3), shall be subject to the exclusive jurisdiction of Cyprus Courts.

Notwithstanding the above, ALFARALE is entitled to require any dispute to be determined by arbitration or to refer the matter to the Cyprus Consumer Center For Alternative Dispute Resolution. Please find further details at www.adr.com.cy

PRIVACY POLICY AND CONFIDENTIALITY

Your privacy is very important to us and we are strongly committed to protecting it.

All information provided by you, either through our Site or in our meetings, will be treated securely, lawfully and in accordance with the laws of the Republic of Cyprus.

We will not disclose our clients’ personal information to any third party, our controlled subsidiaries and affiliates, without the client’s consent, and all information concerning the business, affairs, trade secrets, technical, commercial, financial, operational, marketing or promotional information or date in relation to the services provided by this Site will remain confidential, except as may be required by law, court order or any governmental or regulatory authority.

We shall be entitled to process your data in accordance with the terms of our Privacy Policy and our terms and conditions.

All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.

These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our Site and the way we expect users to behave on our Site.
